By using our platform, you acknowledge that Contractor&Co is not liable for any issues, disputes, or unsatisfactory results arising from contractor services. Any agreements or arrangements are strictly between you and the contractor.
1. Introduction
Welcome to Contractor&Co. By accessing or using our platform, you agree to these Terms and Conditions. Contractor&Co provides a marketplace where clients can connect with independent contractors. We are not a contractor ourselves, nor do we employ or directly supervise contractors listed on our platform.
2. Screening and Vetting
Contractor&Co conducts screening and vetting of contractors before they are listed on our platform. Screening may include verification of qualifications, licenses, references, and background checks where applicable. While we take reasonable steps to vet contractors, Contractor&Co does not guarantee the accuracy, reliability, or completeness of contractor information. Screening does not create any warranty or liability for Contractor&Co regarding contractor performance or conduct.
3. Independent Contractors
Contractors listed on Contractor&Co are independent professionals. Contractor&Co does not control, direct, or guarantee the quality, safety, legality, or timeliness of services provided. Contractors are solely responsible for their work and compliance with applicable laws and regulations. Contractor&Co is not responsible for contractor negligence, misconduct, breach of contract, or unlawful activity.
4. Limitation of Liability
Contractor&Co shall not be held liable for any damages, losses, disputes, or unsatisfactory outcomes arising from services provided by contractors. This includes, but is not limited to, direct, indirect, incidental, consequential, punitive, or special damages. Contractor&Co does not warrant or guarantee the performance, reliability, or results of any contractor or job. Any agreements made between clients and contractors are strictly between those parties. Contractor&Co is not a party to such agreements.
5. Client Responsibilities
Clients are responsible for conducting their own due diligence before hiring a contractor, even after our vetting process. Clients must ensure that the scope of work, payment terms, and deadlines are clearly agreed upon with the contractor. Clients assume all risks associated with hiring and working with contractors. Clients agree not to hold Contractor&Co liable for any disputes, damages, or claims arising from contractor engagements.
6. Dispute Resolution
Contractor&Co is not responsible for mediating or resolving disputes between clients and contractors. Any disputes must be resolved directly between the parties involved. Contractor&Co may, at its discretion, provide limited support such as communication assistance, but is under no obligation to intervene.
7. No Warranty
Contractor&Co provides its platform “as is” without warranties of any kind, express or implied. We do not guarantee uninterrupted access, error-free operation, or the accuracy of contractor information. Contractor&Co expressly disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
8. Indemnification
By using Contractor&Co, clients agree to indemnify, defend, and hold harmless Contractor&Co, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses arising out of contractor engagements or misuse of the platform.
9. Force Majeure
Contractor&Co shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, acts of government, labor disputes, internet outages, or other unforeseen events.
10. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
11. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of South Africa. Any legal proceedings related to these Terms must be brought in the courts of South Africa.
12. Amendments
Contractor&Co reserves the right to update or amend these Terms and Conditions at any time. Continued use of the platform after changes constitutes acceptance of the revised Terms.

2. Intellectual Property Rights
All content, trademarks, logos, and materials displayed on the Contractor&Co website are the property of Contractor&Co or its licensors. Unauthorized use, reproduction, or distribution is strictly prohibited.
3. No Partnership or Employment
Use of Contractor&Co does not create any partnership, joint venture, or employment relationship between Contractor&Co and contractors or clients. Contractors remain independent professionals at all times.
4. Limitation on Claims
Any claim against Contractor&Co must be brought within seven (7) days of the cause of action arising. Claims brought after this period are barred.
5. Entire Agreement
These Terms and Conditions, together with the Disclaimer and Privacy Policy, constitute the entire agreement between Contractor&Co and users of the platform, superseding any prior agreements or understandings.
